Terms of Sale

These terms cover buying and using a Gapreel license. Gapreel is made and sold by Nia D Pham, an individual based in Vietnam ("we", "us", "our"). By buying or using Gapreel you agree to these terms. If you buy for an organization, you confirm that you may bind it to these terms.

1. Who processes your order

Orders are processed by Polar (polar.sh), which acts as merchant of record. Polar handles payment, sales tax or VAT, and invoices, under its own terms. Prices are in US dollars. The price you pay is the one shown at checkout.

2. Free trial

Gapreel includes a 30-day trial with every feature. No payment method is needed. After the trial, without a license, the app moves to the Free plan: it keeps recording, with a 5-minute cap per recording, and Pro features lock.

3. What you buy

4. Activation and offline use

The app activates once per Mac with Polar and then re-checks the license once a day. A Mac that cannot reach Polar keeps working for 30 days of use. After that it needs one successful check to keep Pro features on.

5. Refunds

You can ask for a full refund within 14 days of purchase. The details are in the Refund Policy. A refunded license key is revoked, and every Mac using it moves to the Free plan at its next license check.

Your recordings, screenshots and clipboard history are yours. They stay on your Mac unless you send them somewhere. You are responsible for what you record and share, including other people's content and personal data shown on your screen.

8. Third-party services

Features that connect to other services, such as cloud storage, a narration service, Anthropic, trace collectors or AI agents, use your own accounts with those services and their terms. What those services charge you is not part of the Gapreel price.

9. Ownership

Gapreel, its code, name and design belong to us. The license lets you use the app. It does not transfer ownership.

10. Ending the license

You may stop using Gapreel at any time. We may deactivate a license that was obtained by fraud, refunded or charged back, or used in breach of section 6.

11. No warranty

Gapreel is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We do not promise that the app is error-free or that a recording will capture everything on screen. Keep your own copies of recordings you cannot lose.

12. Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for lost data, profits or business. Our total liability for any claim is limited to the amount you paid for your Gapreel license.

13. Your consumer rights

Nothing in these terms limits the rights you have as a consumer under the law of the country where you live and which cannot be waived by contract.

14. Governing law and disputes

These terms are governed by the laws of the Socialist Republic of Vietnam, without regard to conflict-of-law rules. We will first try to settle any dispute with you in good faith by email. A dispute not settled within 30 days goes to the competent courts of Ho Chi Minh City, Vietnam, unless the law of your country gives you the right to use your local courts.

15. Changes

We may update these terms and will update the date at the top. The version on this page at the time of your purchase applies to that purchase.

16. Severability

If a court finds one provision unenforceable, the rest of these terms stay in force.
